A leaf from history: Zia rejects PNA’s conditions

By Shaikh Aziz

The news of Z.A. Bhutto’s conviction shocked the PPP workers and supporters who hadn’t thought that Gen Zia would stoop so low. Though some violent protests took place in parts of Lahore and Sindh, the general law and order situation was not seriously affected as the government had taken measures to prevent the breaking out of any violence. For some reason the upper leadership of the party remained out of the scene, leaving the PPP workers directionless.

The military courts became over-active in handing down punishments of jail time and lashing. It was clear that the government wanted to send a message to the top PPP leadership that they could also be arrested in order to keep the administration working smoothly.

Two days after the judgment, on March 20, 1978, retired Gen Tikka Khan was arrested under martial law regulation No 33 for his involvement in political activities. Benazir Bhutto who was under house-arrest at her Karachi residence moved the Sindh government to arrange her meeting with her father at Lahore jail. The meeting was arranged for March 25.

The military regime cracks down on protests in the wake of Bhutto’s conviction

The PPP lawyers worked round the clock to prepare an appeal to be filed in the Supreme Court. Some PPP leaders were of the opinion that there was no need to file an appeal against the verdict; instead they wanted to approach the military government through friendly circles to settle the matter amicably. However, saner elements in the party prevailed and finally an appeal was filed in the Supreme Court on March 25.

As the foreign minister in Ayub Khan’s government and later as the prime minister, Bhutto had developed friendships with a number of world leaders, especially in the Third World and the Arab countries. Now facing a death sentence he hoped they could prevail upon Gen Zia to spare his life. While messages from world leaders were coming in calling for a pardon for Bhutto, Libyan leader Muammar Qadhafi’s envoy, Abdul Ali Ubaidi, called on Gen Zia and conveyed to him a message from his president. Zia told him that at this stage the matter was pending with the highest court and he did not want to interfere in it.

While meeting foreign leaders Gen Zia always made sure that the meeting took place without any aide. It was, therefore, impossible to make out what the contents of the talks were and what transpired, leaving the people guessing.

Relieved of a major task of handling Bhutto which was now being done by the courts, Gen Zia focused his attention on strengthening his position politically. However he camouflaged his attempts in such a manner that he could not be blamed for being too ambitious. In this regard he was equally helped by some political leaders. He also began studying the lives and working styles of eminent dictators, like Napoleon Bonaparte, Adolf Hitler, Marshal Tito and Mussolini, who stayed in power for many years without being challenged by the people. He apparently wanted to learn how these dictators managed to retain power for so long. He also used to engage some of his associates in debates on what style of governanvce would work in Pakistan.

During this time it appeared that the Pakistan National Alliance (PNA) was heading towards a break-up; Asghar Khan and Maulana Noorani had already parted ways. After the overthrow of Bhutto’s government, the PNA had decided to keep away from any interim arrangement offered by the military government. They remembered the performance of the Advisory Council Gen Zia had formed on Jan 14 to run the affairs of the government. Though the task of the council was to help in handling state affairs, Gen Zia himself supervised everything which negated the purpose of the council.

Pakistan: When chaos rules

By Vikram Sood (ANI) – New Delhi, Sept.2

Kuj sheher dey log vi zaalim san. Kuj sanu vi maran da shauk si (Azim Muneer Niazi)

The kind of government Pakistanis want is entirely their choice. Democratic, dictatorial, camouflaged military, Islamic, socialist or controlled. The rest of the world may like one or the other but will have to deal with the reality, in its own way. Attempts by others to change systems are messy, with little guarantee of success or permanence.

However, if the people of the country have decided that they wish to follow the route of free and fair elections and to be ruled by a democratically elected government then the present turmoil in Pakistan is not only inexplicable but also dangerous for Pakistan. When political leaders rely on unconstitutional support for political survival and encourage their followers to disregard established norms and institutions then they encourage chaos and unending violence. This ultimately destroys them because the institutions that protected them have ceased to exist.

Chaos rules in Pakistan as conflicting reports come from Rawalpindi and the streets are controlled by the followers of Tahirul Qadri and Imran Khan while the Prime Minister remains invisible. The Army’s initial ambivalence, instead of a forthright support for Nawaz Sharif, indicated weakening support for him. Quite obviously, Nawaz is being punished for pursuing former Army chief General Musharraf.

There are conflicting reports emanating from Islamabad about the future of a democratically elected Nawaz Sharif. The highest judiciary has stepped in with its advice, the parliament has been called to session tomorrow and Imran Khan and Tahirul Qadri have been booked for treason. The entry into PTV offices and the PM’s house despite the Army’s presence in Islamabad indicates a seriously dysfunctional government.

Meanwhile, Nawaz Sharif announced he is not quitting after his three hour long meeting with the Army chief General Raheel Sharif seems to have strengthened Nawaz’s position. Latest reports indicate that protests in Islamabad have resumed. The protests have lasted 18 days and requires considerable organisation and cash flows to sustain this campaign. The Khan-Qadri duo must be flush with money or have unknown benefactors. The disclosure by PTI President Javed Hashmi that Imran Khan had decided to move to the Prime Minister’s after receiving a ‘message’ via Sheikh Rasheed and Saifullah Niazi, is telling.

Pakistani military – back in charge

Crisis in Pakistan could become unmanageable

Excerpt;

The ongoing violence prompted the top generals of the nuclear-armed state to hold an emergency meeting on Sunday, August 31. The army – which has directly ruled the nation for more than three decades collectively – voiced support for democracy, but also “expressed concern.”

Pakistani military – back in charge

But many people in the country think the army’s “concern” is part of the script that the generals have written themselves. Pro-democracy activists believe Khan and Qadri have the full backing of the army, which is wary of Sharif’s cordial moves towards the country’s regional arch-rival India. The PM and the army are also not on the same page over the Islamic Republic’s Afghanistan policy, nor on the future of Pervez Musharraf, former military chief and ex-president, who is currently detained.

The military, which has been in control of the country for most of its recent history, enjoyed limited power during the five years former President Asif Ali Zardari was in office. The generals fear that if Sharif remains in power, they may further loose grip on the country’s defense and foreign policy.

Article 6 to be applied to Musharraf even if sky falls: SC

By Sohail Khan

ISLAMABAD: The Supreme Court on Thursday ruled that it would implement the Article 6 of the Constitution in the Pervez Musharraf treason case even if the sky falls.

The grim ruling came during the hearing of a set of identical petitions by a three-member bench of the apex court comprising Justice Jawad S. Khawaja, Justice Khilji Arif Hussain and Justice Ejaz Afzal Khan.

The petitions seek the trial of former President Gen. (retd) Pervez Musharraf for high treason for abrogating the Constitution. The apex court observed that hearing into the instant case would not be a futile exercise but would be decided in accordance with the law.

“There is no question of futility and the case would be decided in accordance with the law,” remarked Justice Khawaja while responding to Musharraf’s counsel Ahmed Raza Kasuri.

He further remarked that under the law, Secretary Ministry of Interior had to lodge a complaint against Musharraf under the Article 6 of Constitution read with High Treason (Punishment) Act 1973 for subverting or abrogating the Constitution.

Justice Khilji Arif Hussain remarked that if those responsible for fulfilling their responsibilities failed, the court would do it accordingly.

Musharraf’s return: The graveyard is full of indispensables

By

“We rotate these days among people … the only being who cannot and will not perish is your Lord.”

We were inside the parliament building, saying Friday prayers after a stormy Senate session. What we witnessed inside made all of us feel humble and subdued.

“Put Pervez Musharraf in the same cell where he put Nawaz Sharif. Let snakes and scorpions into his room. Let him cry out in pain,” said one of the senators as the lawmakers vented their anger against the former military ruler.

“Handcuff and shackle him and parade him through the streets,” said another senator.

I opened a little window to the recent past and found myself in the army chief’s official residence in Rawalpindi where Musharraf was staying after toppling Nawaz Sharif. He was still the chief executive of Pakistan, a strange title he coined for himself before moving to the president’s office.

We were there with a media team to interview him. Some members of his advisory team were also there, including a Rawalpindi politician. Musharraf sneezed. Three of these advisors ran to him, holding tissue papers. The Pindi politician reached him first. Others looked at him with envy.

None of them came forward to defend the former dictator when PPP, PML-N and ANP lawmakers berated him this Friday, although some of them were present during the debate too.

The senators also targeted the caretaker government for failing to arrest Musharraf after an Islamabad court refused to grant him bail.

They wanted him “hauled to the worst prison” in the country, as a PPP senator said. Later, one senator also suggested that he should be hanged for toppling a lawfully elected government.

Above all, they wanted him “disgraced, dishonored and humiliated” as a “warning to future adventure seekers.”

The retired general, however, had already suffered much humiliation. The man who once hauled the country’s chief justice to his office and tried to persuade him to resign is now forced to appear before junior magistrates, seeking bail.

But that’s not enough for his enemies. They want more. “Do to him what they did to Zulfikar Ali Bhutto, Benazir and Nawaz Sharif,” said one senator, ignoring a plea from the Senate chairman not to get carried away.

The sane among them, however, did warn their colleagues not to go too far. “The ground realities must not be ignored,” said a senior PPP senator. “After all, he is a former army chief and the military obviously will not like this humiliation.”

He urged the angry politicians to seek a way out, proposing “consultation among all stake holders,” i.e. the interim government, the judiciary, PPP, PML-N, ANP and the military.

Other senators also agreed with the suggestion, saying that starting a treason trial against Musharraf will not stop at him. “Don’t forget that the present army chief was also attended Musharraf’s meeting with the chief justice,” said a senator.

High Treason: Senate passes resolution to try Musharraf under Article 6

ISLAMABAD: The Senate on Friday unanimously passed a resolution calling for a trial of former military ruler General (retd) Pervez Musharraf under Article 6 of the Constitution for derailing democracy and abrogating the constitution.

The resolution was tabled by Pakistan Muslim League – Nawaz’s Senator Ishaq Dar and was approved by all members of the Upper House of Parliament.

The resolution also demanded that all photographs, posters and banners of the former president be removed from all government buildings with immediate effect.

The Senators also called for the implementation on its earlier resolution of January 23, 2012.

Moreover, Federal Interior Minister Malik Muhammad Habib Khan informed the Senate that Musharraf was already in the government’s custody and that his Chak Shahzad residence had been declared a sub-jail.

Senators demand Musharraf’s arrest for supremacy of law

By

ISLAMABAD: Lawmakers in the Upper House of the Parliament Thursday demanded action against former President General (retd) Pervez Musharraf for his crimes against constitution, democracy, political leadership and the nation.

They also demanded from the caretaker interior minister to inform the House how he escaped from the court to his residence and “why a former General could not be arrested if the elected prime ministers of the country can be sent to jails.”

Speaking on points of order, the senators claimed that double standard existed in the country in violation of the Constitution which considers every Pakistani equal before the law.

“We have been talking of the rule of law and independence of judiciary. But, today we have seen that it is easy to send an elected prime minister to jail but a former General and military dictator cannot be arrested,” remarked senior PPPP Senator Raza Rabbani.

“In Pervez Musharraf’s case it is test of time. When the court had ordered to arrest him, then why he was not arrested. It’s a question mark,” Rabbani added.

He charged Pervez Musharraf of involvement in the abetment of killing of Benazir Bhutto and Nawab Akbar Bugti, abrogating the constitution and house arresting the judges of superior judiciary.

“Musharraf is a usurper who twice abrogated the Constitution. He was announced to be arrested but he safely fled in connivance with state institutions. The caretaker government was responsible to arrest him and the interior minister should inform the House why the government had not fulfilled its obligations,” Rabbani said.

PPPP Senator Farhatullah Babar said he does not hold caretaker government responsible for his escape. “I have been looking the state apparatus very closely. There are two laws and double standards in the country. If we could not mend it over the time how we can hold the caretakers responsible for these double standards.”

Is it Musharaf’s political Kargil?

Is Musharraf going for a political Kargil?

by Dr Ghayur Ayub

Gen. (rtd) Pervez Musharaf is a commando trained by a well disciplined army. Against such background, he is known to have taken risks during his career. He makes tactical and strategic plans and executes them accordingly. He does not get discouraged if his tactical plan fails and waits for proper time to strike at strategic level. Take Kargil episode for example. In 1995 he put the plan and presented it to the then PM Benazir Bhutto. It was turned down. He retreated it tactically but kept it alive strategically for future. When the time came he executed it. That’s how his brain works.

When he was the most powerful leader heading Pakistan with four caps, he shouldered MQM in political gusto and made it the most powerful ally in Sindh controlling the economic hub of Pakistan. During his tenure Mustafa Kamal, the administrator of Karachi, was given a privileged reception when he visited America; thanks to him. It was in those days when a news appeared in media that he might join MQM. He never rebutted it. This was his tactical move to be counted as a political player.

Altaf Bhai who has many political eyes on his face and matching ears on his head realised the consequences. He took it as Musharaf’s tactical move to enter MQM and push him to one side later as part of strategic plan taking over the party leadership. He became active and made sure it did not happen. To show his command over the party he brought down two important personalities of MQM to their knees- Dr. Liaqat Hussain and Mustafa Kamal. It happened both were close to Musharaf. The former was thrown out of the party.

Thus Altaf Bhai was successful in obstructing his tactical move. Being Musharaf, he let it go but held to his strategic plan. According to news coming out of London, he maintained his links with a few old guards of MQM such as (late) Dr Imran Farooq. Were those links part of the strategy? Is it also part of that strategy which landed him in Pakistan? Keeping his Kargil episode in mind it may not be surprising to link it with that. Only this time he might be planning to fight political Kargil on three fronts; to clear his name in court cases; to make inroads in MQM; and to isolate Nawaz Sharif. How?

Before going to Pakistan he went for ‘a politicised Umra’ and prior to that he apparently met Nawaz Sharif in Saudi Arabia with blessings of the West and Saudi Arabia.

Creation of Metropolitan Corporations

· Government will create Divisional Head Quarter of Karachi, Hyderabad , Sukkur, Larkano and Mirpurkhas as Metropolitan Corporations But Karachi Metropolitan will be consist of five districts [Note: only Karachi is different from all other Metropolitan all other metro will be consists of only one district while Karachi five]

According to 1998 census MQM has only majority in two districts out of five. If Karachi Metro consists of five District Councils then MQM can have control on only two district councils and they cannot even win mayor ship of Karachi Metro! So MQM knowingly using this Ordinance created Karachi Metro based on five districts instead of 18 towns.

· Union Council boundaries with in the Metro area cannot stretch into any Talku or town

Please note that this doesn’t apply to Town boundaries, there are 5 districts and 18 towns are in Karachi. 18 towns were created in dictator Gen. Musharaf period gerrymandering so that MQM elect their Mayor. It was not possible before since out five districts MQM can only elect two districts only.

This also shows that Karachi is different from other Metro areas.

· Through this ordinance Mayor and Chairman have authority to remove encroachment and maintain peace using Criminal Procedure Code 109, 133, 143, 144 and 145 under the Police act of 1861 and under section 30A-34B. Also they have section 144 under their authority.

Using this authority MQM Bulldoze any Sindhi area, do not allow any political rally and activity, remove any flood relief camps etc.

· Using their financial resources councils have authority to create any new department

Obviously only Karachi and Hyderabad has revenue to create any new department. We already had seen how MQM created city police by recruiting its entire party worker. Rest assured how will these departments server the city.

· Using this ordinance Deputy Commissioner office becomes irrelevant and all the powers are transferred to Chief Officer, who reports to Metro Government. Only revenue matters left to DC office but Karachi will be different again.

Now you can imagine how MQM will utilize Chief Officer Office.

· Financial grant of Metro based on its financial needs, revenue potential and revenue generation

In other words since Karachi and Hyderabad generate most the revenue hence they need more money and rest of Sindh will go to hell. There is no parity for poverty which considers in federal divisible pool.

· Using this Ordinance there are many departments moved to Metro area but most consequential are primary education and fisheries

If Karachi metro can regulate primary education it means the small number of Sindhi medium school running will be closed and there will be no new sindhi medium school will open. Also fisheries department transferred to Karachi Metro mean they will regulate all the harbors where majority of Balochs and Sindhi currently works. They will also not allow any new fishermen housing society in future.

· Military dictator Gen. Musharaf police Ordinance only reactivated in Karachi only, rest of Sindh will still in 1861 act

Save Sindh committee calls for strike today

The Save Sindh committee (SSC), an alliance of nationalist parties in Sindh has called for shutter down in Sindh today (Monday) after Qaim Ali Shah government in Sindh showed its intention to present controversial local government ordinance in the provincial assembly for making it a permanent law.

With the ordinance which drew severe criticism in Sindh, the government restored 18 Towns of Karachi and a notification in this regard was issued on Saturday.

The system as its opponents claim replicates the one introduced by military dictator Gen Musharraf with a malicious design of dividing Sindh into two parts.

The SSC convener Syed Jalal Mehmood Shah said it was a huge plot to divide Sindh and, they would never allow it to be implemented. Mr. Shah and his committee leaders including Dr. Qadir Magsi were in Thatto in connection to their campaign against the local government law. They appealed to the people of Sindh to observe strike today.

After the SSC’s call, reports said, the workers of the SSC parties staged protest demonstrations in various cities and towns of the province.

Also, there were reports that they besieged the house of a PPP MPA Dr. Magsi announced they would put siege around the houses of the members of Sindh Assembly today. The strike call is also supported by the PML – N, JI and other parties. The PML – F and its allies including the PML – Q and NPP have announced that they would severely protest in the assembly. They have their members in the assembly who have already sought separate seats on opposition benches in the house. KARACHI: TP Report, October 1, 2012

I am disgusted at what Zia did to Pakistan

By Omer Kamal bin Farooq

To begin with, I absolutely loathe generals in uniform running countries. No matter how incompetent the politicians are, how relevant the doctrine of necessity is and how much of a messiah the man in the boots is, there is something very corrupt and amoral about the whole thing.

I remember watching Ziaul Haq’s martial law speech for the first time as a teenager during the peak of the lawyers’ movements. As a child who grew up in Musharraf’s martial law, I, for the first time, was discovering terms like ‘judicial independence’, ‘supremacy of the constitution’, and the ‘primacy of democracy‘. I was caught up in the romance of all that.

Then I saw his speech in which he shamelessly went on about how “Mr Bhutto’s” government has been brought to an end, assemblies dissolved and ministers removed.

What flabbergasted me was how could a man say all this in one sentence and never stutter for once. How could he tell his “aziz humwatno” (dear countrymen) that they are inconsequential and their elected institutions and people are nothing more than fragile toys left to the whims of a badly brought up child?

But he did all this, never being weighed down by the burden of his own words. Heck, he even talked about the constitution in the last part of the sentence. So the constitution, head of the government, provincial and national assemblies, ministers and governors, all went in the same sentence and the man did not even show a modicum of remorse. Despite this, we all know who was hanged in the wee hours of the morning and who got the much celebrated state funeral only fitting for a national hero.

A lot has changed in the last five years since I saw the video of his speech. The lawyers are upholding the law by banning Ahmadi-owned soft drinks and showering cold-blooded murderers with rose petals. Even judicial activism has been harbouring on the fringes of judicial martial law, but one thing has remained constant; my disgust for what Zia has done to my country and what he stood for.

Musharraf Farooqi has a great article up at Lapham’s quarterly about Jinns and their various proclivities. A must read.

“ ….Encounters between the parties were not uncommon. One trait commonly ascribed to jinn is the desire to copulate with humans. Male jinn liked it so much that sometimes they would try and surreptitiously join in during sex between human men and women. One man witnessed his wife’s vagina emitting flames from a jinn making congress with her while she slept. And such interspecies unions bore fruit. When a child was born from a coupling between humans and jinn, it was termed khunnas. One born from a union between humans and demons was called amluq. Humans were less likely to pursue jinn, however, particularly females, as they were reputed to have violent tempers. One man who had married a jinn female received a good thrashing with a camel bone at her hands before she left him…”

Musharraf Ali Farooqi has also translated Dastan Amir Hamza into English (its a very good translation, btw, I have it and its tremendous fun to read in the toilet). He has also started on Tilsim e Hoshruba. (he also wrote a novel recently that I have not yet read).

Aamer Ahmed Khan (who replaced Mohammed Hanif as head of BBC Urdu)  tried to start a series of Tilsim E Hoshruba comics in Lahore, but these ideas seem to whither and die in Pakistan. After the “Islamic welfare state” deal is finally done with, maybe some remaining people  will rediscover the real treasures of medieval Islamicate culture (Jinns, Arabian Nights, Tilsim e Hoshruba) and make comics and video games and movies out of them in the land of the Indus man (for now, it seems they do it best once they get out); all sorts of creative possibilities exist…

My theory is that all these creative possibilities tend to get overwhelmed in Pakistan (the actual Pakistan, not the imaginary one..hint hint, wink wink) because we need Jinns to produce literal rather than metaphorical electricity.

The real reason for the rot – Mir Mohammad Ali Talpur

There is absolutely no challenge to what the army does or has done in the past and this too is a natural corollary of the genesis of this state

Nations are products of long historical and evolutionary processes; most present nation states evolved thus. But when states are formed on an artificial basis of contrived nationhood or on the basis of religion, as was the case with Pakistan, Israel and Yugoslavia, they of necessity turn into fascist states, dominated by a militarist ideology. Serb-dominated Yugoslavia denied rights to other nationalities and eventually imploded. Pakistan by claiming to be the legatee of the glory of Islam burdened itself with heavy historical baggage, but then it could not have done otherwise as it was that claim that it wanted to justify its artificial existence with. Consequently, Pakistani rulers in keeping with its elite’s interests curtailed national rights of different nationalities, and forced them to rally under the banner of religion and to accept its ideology by upholding their brand of Pakistani nationalism.

The Baloch, Bengalis, Sindhis and to a certain extent, the Pashtuns resented and resisted this imposition in varying degrees. The Bengalis having had the advantage of distance and a sympathetic neighbour went their separate way in 1971, while the Baloch after an initial period of freedom have borne the brunt of military operations because of their refusal to accept the artificially imposed ideology of a Muslim nation and have so far thwarted the attempts to crush their determination for a separate entity status. The Sindhis, at first taken in by state-sponsored ideology, gradually realised that their interests did not coincide and have resisted it though erratically at best since.

Fallout from Arsalangate

By Khaled Ahmed

The PPP government was already in the dock for corruption. Arsalangate dragged some other entities into it: the army, the media, and the chief justice

Malik Riaz Hussain, arguably the biggest real estate developer in Pakistan with ‘connections’, decided to reveal that he had been blackmailed by the son of Chief Justice of Pakistan Iftikhar Muhammad Chaudhry and had allegedly been forced to spend nearly Rs 40 crore on him. He used journalists of a media house on a social media website to deniably make his case, after which the country witnessed a full-blown media scandal undermining the authority and credibility of the Supreme Court.

Called to the Supreme Court on suo motu, Malik Riaz submitted evidence of payments made to Dr Arsalan Iftikhar. He then went on TV and made additional allegations, some of them implying that Chief Justice Chaudhry may have been aware of what was going on. In answer, Dr Arsalan Iftikhar claimed that he had never met Malik Riaz and that he had received no payments from him or his relatives to finance his clearly lavish holidays abroad. Chief Justice Chaudhry expressed his complete lack of knowledge of all this.

The linguistic divide: One partisan of the debate that followed stated: ‘The Chief Justice took suo motu notice of the case and presided over the Bench while in the complete knowledge of the code of conduct of Judges. Given the experience and acumen of My Lord, the Chief Justice, one can say to a moral certainty that he would be aware of the general principle and the specific provision of the code of conduct, which requires judges not to hear matters involving immediate family members’. This comment was in English.

The first divide became visible on the subject and it was linguistic. In Urdu, the issue was addressed in the light of the example of Hazrat Umar who presided over the trial of his son and punished him with his own hands. This linguistic split – which is the most glaring ideological bifurcation in the country – was followed by politicians squaring off against one another: the PMLN and Tehreek Insaf announced themselves on the side of Chief Justice. They accused the ruling PPP of having engineered entrapment through Malik Riaz to get rid of the Chief Justice.

First Army, then TV Anchors: The media rallied to the defence of the Chief Justice. Most of the TV anchors thought it was a conspiracy to challenge the Chief Justice because he had made pointed investigations into “disappearances” in Balochistan. The implication was that the Army was offended and wanted the judge to ‘lay off’, and had used Malik Riaz to make revelations about Arsalan whose reputation was already subject of rumours in Pakistan for some time.

Pakistani Supreme Court has gone overboard – says Justice Markandey Katju (Supreme Court of India)

It has no right to dismiss a Prime Minister or overrule the constitutional immunity given to the President

By: Markandey Katju

When I was I was a student of law at Allahabad University, I had read of the British Constitutional principle ‘The King can do no wrong’. At that time I did not understand the significance of this principle and what it really meant. It was much later, when I was in law practice in the Allahabad High Court, that I understood its real significance.

The British were experienced and able administrators. They realized from their own long, historical experience that while everybody should be legally liable for his wrongs and made to face court proceedings for the same, the person at the apex of the whole constitutional system must be given total immunity from criminal proceedings, otherwise the system could not function. Hence the King of England must be given total immunity from criminal proceedings. Even if he commits murder, dacoity, theft, or some other crime, the King cannot be dragged to court and made to face a trial.

One may ask why should the King be given this immunity when others are not? The answer is that in the practical world one does not deal with absolutes. The British were one of the most far sighted administrators the world has known. They realized that if the King is made to stand on the witness box or sent to jail, the system could not function. A stage is reached at the highest level of the system where total immunity to the person at the top has to be granted. This is the only practical view.

Following this principle in British constitutional law, almost every Constitution in the world has incorporated a provision giving total immunity to Presidents and Governors from criminal prosecution.

Thus, Section 248(2) of the Pakistani Constitution states:

“No criminal proceedings whatsoever shall be instituted or continued against the President or Governor in any Court during his term of office.”

The language of the above provision is clear, and it is a settled principle of interpretation that when the language of a provision is clear the court should not twist or amend its language in the garb of interpretation, but read it as it is.

I therefore fail to understand how proceedings on corruption charges (which are clearly of a criminal nature) can be instituted or continued against the Pakistani President.

Moreover, how can the court remove a Prime Minister? This is unheard of in a democracy. The Prime Minister holds office as long he has the confidence of Parliament, not the confidence of the Supreme Court.

I regret to say that the Pakistani Supreme Court, particularly its Chief Justice, has been showing utter lack of restraint. This is not expected of superior courts. In fact the court and its Chief Justice have been playing to the galleries for long. It has clearly gone overboard and flouted all canons of constitutional jurisprudence.

The Constitution establishes a delicate balance of power, and each of the three organs of the state — the legislature, the executive and the judiciary – must respect each other and not encroach into each other’s domain, otherwise the system cannot function. It seems to me that the Pakistani Supreme Court has lost its balance and gone berserk. If it does not now come to its senses I am afraid the day is not far off when the Constitution will collapse, and the blame will squarely lie with the court, and particularly its Chief Justice.

The day justice was dispensed! – by Bahadar Ali Khan

A malifide intended PM has been disqualified. Every one on the streets is reciting ‘Va ja ul-hukke va zahaq-al-batil, Innul batila kana zahuka’. Finally piety, chastity and good has prevailed. There is fresh breeze of purity that is causing stir on the horizon of virtue. Crying babies have started giggling, trees and crops have started smiling, milkmen started distributing non-contaminated milk, the sounds of angels’s wings have started spurring on the sovereign aerospace of Pakistan, the faces of parliamentarians are beaming with the new respect that they have attained and last but not least executive has finally cheerfully decided to not to interfere in the craft of running a government again, ever! And every one is going to live happily ever after. Right?

I don’t know about you but personally I don’t agree with my above bizarre juxtaposition. Reality is actually more grim. From the history, we know there were times when military dictators would topple elected governments and aggrieved party would go to Supreme Court as a last recourse. But times have changed now. A bad and corrupt Prime Minister has been disqualified by an honest and upright judiciary. The maligned fellow was in General Musharraf’s dungeons when the same esteemed judges were taking oath under PCO ( not once but twice ) and gifted the blank cheque decisions to the dictator to amend the constitution, the way he pleased to do so.

ANALYSIS: Sindh — fox guarding the henhouse — By Mohammad Ali Mahar

Sindhis overwhelmingly voted for the PPP, mainly due to the fear that supporting smaller groups would be tantamount to bringing their oppressor, namely the MQM, back to power

The English language expression of a fox guarding a henhouse could not have been better illustrated than through the Liyari operation and the incidents of May 22 in Karachi.

Throughout the 65 years of the country’s existence, Sindh has suffered incessantly but never as severely and as brutally as during the last four years of the government elected chiefly through the Sindhi vote. Granted, there have been times of suppression and repression during successive military regimes, latest of which being General Musharraf’s misrule. However, the military regimes cannot be blamed as much — for theirs was a clear-cut and naked repression and not disguised in the garb of democracy — as is the case this time around.

Sometimes, the Sindhi feels that he is being punished by the divine power for bringing into power a gang of men and women well known for their misdeeds than any good they may have done in their lives. That there was no other choice for Sindhis at that time is something completely overlooked by the chastising powers.

Sindhis overwhelmingly voted for the PPP, mainly due to the fear that supporting smaller groups would, they thought, be tantamount to bringing their oppressor, namely the MQM, back to power. Having endured long years of repression at the hands of the MQM and Musharraf’s marionettes in Sindh during his quasi-military rule and losing their beloved leader, Mohtarma Benazir Bhutto, Sindhis thought that the return of the PPP to power would mean an end to their suffering. What they did not know at that time and have learned the hard way is that by voting the PPP to power, they got exactly what they wanted to avoid in the first place. The situation as it is right now is such that half of Sindh is being governed by the MQM and the other half by someone named Owais Tappi — nobody knows who exactly this gentleman is. There being many stories surrounding Mr Tappi’s persona and his alleged mysterious relationship to Mr Zardari.

Then there is a third force — the Interior Minister Rehman Malik. Running the internal affairs of Sindh from the Centre through such a man of questionable credentials as Malik is the biggest insult to the Sindhi voter’s trust. That a man the former Home Minister of Sindh, Zulfiqar Mirza, publicly accused of facilitating and abetting the criminals belonging to the MQM, remains responsible for the affairs of Sindh, raises a number of questions regarding the party leadership, especially Mr Zardari’s sincerity regarding maintenance of peace in Sindh and his lack of sensitivity to Sindhi sentiment. Why, when other ministers keep changing on trivial excuses, the demand to remove Malik from the affairs of Sindh falls on deaf ears despite the colossal damage he has done to the party in Sindh? An example has been made of Babar Awan, who at times proved to be more loyal to the king than the king himself, but fell from grace when he refused to testify in favour of Mr. Gilani. Why then a person who, a PPP jiyala asks, caused the death of tens of people in Liyari and wiped the PPP from the walls and streets of its strongest fort as well as hearts of its inhabitants, is still there?

It is said that the leadership of the ruling party has business interests to share with Malik and therefore they cannot afford to alienate him, but can he not be given some other, maybe a better job to do, and leave Sindh alone? Why do the boundaries of his ministry end at Sindh and not include Punjab, where he belongs and where life is tougher for the PPP supporters than elsewhere in the country? Why is he protecting a particular linguistic terrorist group, when even the security agencies acknowledge the party’s foreign connection? The bigger question is who/what is the power behind Malik and the MQM seeing to it that they continue to do whatever they are doing with impunity? Do they really share the same paymaster, as it is widely perceived?

As though his actions are not deadly enough for the party, the wounds that Malik inflicts through his insensible remarks — an example being his statements at the time of the Liyari operation and the incident of May 22 — have ensured that Mr Zardari’s party is going to have a hard time in the next elections, at least in Sindh.

From the Liyari operation and the incident of May 22, 2012, when naked terrorism was let loose on the peaceful rally of the unarmed sons and daughters of the soil, one thing has emerged clearly that the PPP has lost all hopes of winning the next elections, especially in Sindh. It looks like all they want is to complete this term at any cost, even at the cost of Sindhi lives.

Unleashing Malik on Sindh brings to one’s mind another English proverb of letting the bull in the china shop. All that the Bhuttos built painfully over the years, Malik has destroyed in four years and made sure that when the next elections come, the PPP is seen nowhere in the province.

Pakistan Splits: The birth of Bangladesh – By J R Saigal

About the Book

Description: Hard Bound, It is for the first time that a book has come out by a senior officer of the 1 Corps in the Western Sector, Shakargarh Region, where the Strike Corps of Indian Army fought its war. As a participant of war, Col. Saigal, analyses 1971 Indo Pak war in his book, and indirectly enables one to have the reasons for Kargil misadventure of the Pak Army. We get a good factual knowledge of Pakistan Army and why it is in the present shape. This book is unique in so far as it gives the insight into Sam Manekshaw’s personality- a fine soldier who has been misunderstood as also of the real liberator of Bangladesh, Lt.Gen. Sagat Singh, about whom very little is known. While narrating the facts of 1971 Indio-Pak war he very rightly spells out a question-Pakistan was spilt while the country had a General at the helm of state of affairs. Will the country be split again with a General at the helm of affairs-a pointer, he argues-as it is not in the interest of Pakistan and India both If a further split occurs, It will be in the interest of foreign powers.

Pakistan: Will the Court punish officials who violated their oath?

Evidently, the state of Pakistan is rotten when its former Chief of the Army Staff, who does not stop touting himself as a true patriot, prima facie, violated the constitutional oath he undertook. It is not just Mirza Aslam Beg whose nefarious involvement in politics has been the subject of discussion in the courts and TV channels but countless others in Pakistan who have been upto similar transgressions and getting away with them.

After the death of Gen Ziaul Haq in 1988, military rule only changed its clothes. It survived and flourished for a decade until the Emperor threw off his civilian façade and took over in 1999 through a proper coup d’etat citing the same old excuse of saving the country. The history of 1988-1999 is yet to be written for it has remained hostage to the obfuscations of a political class created by the army itself and its loyalist intellectuals who rule the media and are found in Pakistan’s moribund academia as well.

We expect SC to apologise for role it played in murder of ZAB: Bilawal

By APP

NAUDERO: “We expect the Supreme Court to apologise for the role it played in the judicial murder of Shaheed Zulfiqar Ali Bhutto,” were the words with which Pakistan Peoples Party Chairman Bilawal Bhutto-Zardari summed up the case of righting his dead grandfather’s name in history, on the eve of the PPP founder’s 33rd death anniversary being observed in Naudero.

With his father, the President of Pakistan and co-chairman of PPP, Asif Ali Zardari watching, along with the PPP central executive committee, hundreds of thousands of loyal party workers which had gathered in Ghari Khuda Bux, and around the country, Bilawal exhorted, “the restoration of these judges by our Prime Minister was a truly historic milestone for our country. Why not punish those who made Osama Bin Laden & his wives stay in Pakistan

Illegal stay: 45-day imprisonment, Rs50,000 fine for Bin Laden’s family

Bin Laden lived in ornate house while waiting for Abbottabad compound to be built

By Associated Press

HARIPUR, Pakistan — It’s an ornate but not lavish two-story house tucked away at the end of a mud clogged street. This is where Pakistan’s intelligence agency believes Osama bin Laden lived for nearly a year until he moved into the villa in which he was eventually killed.

The residence in the frontier town of Haripur was one of five safe houses used by the slain al-Qaida leader while on the run in Pakistan according to information revealed by his youngest wife, who has been detained.

Retired Pakistani Brig. Shaukat Qadir, who has spent the last eight months tracking bin Laden’s movements, told The Associated Press that he was taken to the Haripur house last November by intelligence agents who located it from a description they got from Amal Ahmed Abdel-Fatah al-Sada.

Al-Sada, a 30-year-old Yemeni, has been in Pakistani custody since May 2 when U.S. Navy SEALs overran the Abbottabad compound, killing bin Laden and four other people inside. Since then, Pakistan’s intelligence agency, known as the ISI, has been trying to uncover the trail that brought him to Abbottabad villa in the summer of 2005. …
