A wake-up call

It was the first time on Monday morning that I breathed a sigh of relief that the PTI and the PAT dharna is there and continues to attract attention. Just imagine if the media was not focusing on them they might have taken the trouble of sniffing out the drama which was unfolding in Karachi on September 6. A Chinese manufactured F-22P frigate of the Pakistan Navy, PNS Zulfiqar, came under attack by the Taliban. It is not confirmed as yet if the ship was at sea or docked at the naval dockyard. The story was kept under wraps for two days and disclosed on September 8. It was not that people were not warning others. A friend from abroad had even inquired on Saturday about what was happening in Karachi to which I had no answer as nothing was being reported on television except the Imran/Qadri roadshow. But I am still happy no one reported the story because the last time someone tried to dig out facts about infiltration of militants and ideologues inside the navy it ended in tragedy.

Gladly, the brave sailors and officers saved the day. However, the attack on PNS Zulfiqar, for which the Taliban took the responsibility, proved yet again the vulnerability of the country’s security. What we are always scared to talk about is the support from inside as had happened in the attack on PNS Mehran, PAC, Kamra and other places. Given the fact that little is known about militant penetration, it is difficult to ascertain the threat. This is about men caught by the demon of disbelief of their state and society. Glance through the literature on state making and you can find how monopoly over violence and making sure it stays that way is one of the many characteristics of a viable and efficient state. However, here is the issue of men, who join a profession to guard the state then turning away, because they suddenly suspect the state is not legitimate. The whole concept of jihad or takfir is not a simple issue of people becoming devil-like but erosion of their faith in legitimacy of the state. They begin to desire a perfect Islamic state which can only be brought about by fighting the existing system. Penetrating an armed force becomes an attractive option since achieving such objective tantamount to a force multiplier. A well-trained and oiled war machine can take you places.

Just imagine a situation where militants would try to rebel and take control of a vessel while at sea. Notwithstanding many of the earlier claims that all three services were cleaned during the Musharraf regime, these attacks suggest otherwise. Various religious groups have always had access to men in uniform under one pretext or the other. If it is not the militants then it is Deobandi or Salafi reformation movements such as the Tableeghi Jamaat or Al Huda that are allowed to access military personnel and their families. Reportedly, the households of one of the two smaller services were opened up for Al Huda by the senior leadership. The problem here is not with increased interest in religion but the fact that after a while these families and their men begin to get totally confused about where does duty to religion end and to the state begin. Not that they want to kill innocent colleagues and other people but they are blinded by their understanding of dogma to believe that they have to bring suffering in order to improve the world as ordained by God.

The PNS Zulfiqar attack is yet another reminder that things are getting serious. We need to look at this development in the backdrop of the expansion of militancy and extremism in the form of IS and the al-Qaeda’s Qaedatul Jihad in Indian Subcontinent (QJIS). While many analysts tend to see IS and QJIS from the lens of internal competition amongst militants, especially Zawahiri’s need to build up his strength, some observers argue that the two forces may have different tactics and partners but similar strategic objective. They both want to consolidate and establish a caliphate. In this regard, other existing organisations like the Hizb-ut-Tahrir also have the same desire.

ISI should be accountable – No clue to Rs4.1bn paid to ISI for project

ISLAMABAD: Already in the eye of the storm for its political role, the Inter-Services Intelligence (ISI) agency came under criticism at a Public Accounts Committee meeting on Tuesday for having spent over Rs4 billion on a project which never materialised.

The PAC of the National Assembly was informed that the National Police Bureau (NPB) had handed over Rs2.1bn to the ISI in 2005-06 for setting up an automated fingerprints identification system and a police record and office management system.

The project also included the setting up of a national integrated trunk radio system for police. Later, the amount was increased to Rs4.1bn.

According to an audit report presented before the PAC, the project had to be completed during 2005-06. However, no progress was reported in 2006-07.

NPB Director General Aleena Saeed Iqbal said she had repeatedly sought from the ISI information about the status of the project and details of the accounts, but there had been no response.

Our right to know

The refusal of the Supreme Court Registrar to render to the Public Accounts Committee any details of the plots ostensibly allotted to the Honourable Judges leaves a distinctive and familiar bad taste in the mouth. The reason put forth by the Registrar is that according to Article 68 of the Constitution, no discussion can take place in parliament regarding the conduct of any judge of the Superior Courts  “in discharge of his duties”. The argument is indeed peculiar since I certainly hope that the Registrar is not implying that the land was acquired in discharge of duties. Let us get a few things clear at the outset; firstly, no allegation has been made against any judge or the judiciary. Secondly, even if an extra plot was accepted, it forms no basis of a prima facie misconduct. In this light, the reluctance or the outright denial seems faintly paranoid and defensive, in any event puzzling. I have a feeling that because the Supreme Court thinks that parliament is made up of incompetent crooks, it (the SC) cannot and should not subject itself to scrutiny by them. If that is so, the problem should be obvious: clichés likes “checks and balances”, “who will guard the guards” etc. The SC is empowered to interpret the law and decide what is permissible, yet the refusal comes too close to ambitiously high-minded self-comparisons with two of the four Caliphs. I am against anyone being held to the standards of the pious Caliphs and quite content with imperfect temporal constitutional standards. Yet, to the cynic it may seem as what can be colloquially termed as a “having-it-both-ways” approach.

Supreme Court and Public Accounts Committee

Sharing with you this important document, which has left me shocked and extremely disappointed in the ‘wisdom’ of those who need to be the wisest. Amid all kinds of corruption allegations on politicians being pursued by the Supreme Court of Pakistan (SCOP), one case got special treatment by the worthiest men of this country – the graft case of Mr. Arsalan Iftikhar. Iftikhar is a 34 years old ‘innocent boy’ who was reportedly ‘lured’ into accepting a not-s-small sum of money from one Malik Riaz, the real estate tycoon who knows how to make the mare go. The innocence of Mr. Iftikhar is further proven by the fact that he happens to be the son of Chief Justice of Pakistan. The case was thus, taken up by none other than CJP himself, as a suo-moto action under Section 184(3) which allows the CJP to move the court if the case pertains to violation of fundamental rights and is of public interest. The case, definitely is of public interest and violates Mr. Iftikhar’s right to remain innocent for the rest of his life! The case, as was right thing to do, was disposed of by mildly lecturing all parties to ‘behave’.

Why is it important to recall Mr. Iftikhar? Because his was not the only case where the worthy court to be partisan for its own interest. Responding to Public Accounts Committee, the elected watch body over the Auditor General of Pakistan that called Registrar of Supreme Court to present himself before the Committee and explained some overspending by the SCOP. Guess what happens next? The wise men in SCOP, came up with a document that conveniently leaves everyone in the SCOP outside the ambit of any elected watch body that oversees the transparency of financial transaction by public institutions including SCOP. Have a lok over how the Registrar of SCOP – an official who is not a judge – exonerates himself from legislature’s scrutiny.

One wonders who is going to ensure transparency when even the most responsible institutions of this country try to evade law on the pretext of law. Ironic and sad. The language used in this document and disregard for transparency makes my wish it must not be what the worthy men in SCOP meant. Have a good reading experience please!

Parliament cannot discuss SC judges’ conduct: SC

Supreme Court has said PAC cannot carry out audit of apex judiciary as per Article 58.

According to a report presented to the Public Accounts Committee (PAC) on Tuesday morning three existing and twelve retired judges of the Supreme Court received two residential plots each worth millions of rupees in expensive sectors of the federal capital.

The Supreme Court (SC) refused to provide audit report details to the Public Accounts Committee (PAC) saying the Parliament cannot review judges conduct.

This was said in a reply written by Registrar Supreme Court to the Chairman Public Accounts Committee with the consent of full court bench of the Supreme Court in which it is mentioned that constitution prohibits PAC to call any official including Registrar of the apex judiciary, however President, being head of the state has the authority to decide about the consultative sphere of the Supreme Court, so the committee should consult President of Pakistan

If the committee is interested in a formal court order, it should approach the president , the letter said

The letter referred to Article 68 which said: “No discussion shall take place in [Majlis-e-Shoora (Parliament)] with respect to the conduct of any Judge of the Supreme Court or of a High Court in the discharge of his duties”.

It is worth mentioning here that on the orders of former Chairman PAC Chaudhary Nisar Ali Khan, a letter was written to the Registrar Supreme Court for presenting its accounts before the committee, however it was not dispatched at that time. But new chairman Nadeem Afzal Chan ordered to dispatch it.

Stop Lyari operation: A critical PPP supporter’s perspective – by Syed Salman

Why do those who have had a taste of victimhood forget so quickly and could actually launch the same offensive against others? I seriously ask myself if the ongoing Lyari operation justified?

Without any biasedness I strongly believe that Baloch of Lyari were armed & used by PPP to protect its interest and now they’re being massacred. So the next question would be; will the successful Lyari operation result in peaceful Karachi; no more extortion cases, no street crime at all, no more abductions for ransom etc etc etc. Undoubtedly, criminals do reside in Lyari but do all criminals reside in Lyari?

In my honest opinion, even luring should have a limit. Please excuse me, but PPP government must stop bowing down to the MQM. PPP’s MNA Nabeel Gabool’s security being demanded by MQM speaks out louder than mere words. If PPP led government is so serious in eradicating criminal elements from Karachi, then why not an indiscriminate action against all felonious & illegitimate elements in the city, conducted by rangers in every crime infested area. Why just Lyari and why not Malir, Shah Faisal, Lalo khait, Kareemabad, Jauhar, Orangi town, Banaras, New Karachi, Nazimabad, Kati Pahari?

I have somehow started to believe as if PPP has been hijacked by Rehman Malik’s one-sided compromise as pointed out by Dr. Zulfiqar Mirza already & it’s getting worse. How ironic can it be; Baloch on their own indigenous land (Lyari-Karachi) have been massacred to pave the way for occupiers!

Moreover, ANP should break their silence over ongoing Lyari operation, otherwise innocent Pashtun will definitely be next in Karachi.

I have always had this opinion that Zardari is a very smart politician even smarter than his deceased wife. However, the said ongoing Lyari operation upon his direction falls beyond my comprehending capacity, as to why is he letting PPP vs. PPP happen. All in all, It’s going to be lose-lose for PPP apropos Lyari operation.

In my honest opinion, the ongoing Lyari operation is totally unfair as is incited by criminal elements itself; solely to validate ownership of the city. However, the operation has deeply alienated core supporters of PPP & I am disappointed.

Violence revisits Lyari: Three, including PPP leader, shot dead

SINDH – KARACHI: In a showdown between police and protestors on Monday, three people were killed while over a dozen sustained bullet injuries and were admitted to local hospitals.

Violence revisited Lyari as agitated residents took to the streets and clashed with police over what they described as ‘biased operation’ of law enforcement agencies against the residents of Lyari.

According to sources, PPP leader Hassan Soomro was also shot dead in this recent bout of violence.

PAC meet on canteen scam ends inconclusively

The Public Accounts Committee (PAC) meet on the canteen scam ends inconclusively. The army and the air force have divergent views from that of CAG and the PAC. PAC would hold further meetings to reconcile this.

It’s the first instance of its kin, serving chiefs have been asked to appear before PAC in connection with Canteen scam.

Army Chief General V K Singh, air chief V K Naik and naval vice chief D K Dewan met the PAC headed by senior BJP leader Murli Manohar Joshi and with other MPs. The hearing is in connection with the alleged irregularities in the canteen stores supplies. The PAC meet was called after the CAG report pointed out irregularities in the supply chain management of rations by CSD.

General VK Singh, Army Chief, said, “I am happy to be at meeting. We made a presention on the issues raised by MPs on rations issued to soldiers.” …
