PPP to not respond to court in Swiss case

ISLAMABAD: Pakistan Peoples Party (PPP) categorically refused to submit a letter to Swiss authorities as demanded earlier by the Supreme Court, Express News reported on Thursday. The decision was taken during a meeting of the party’s core committee.

Chairing the committee meeting, President Asif Ali Zardari remarked that the Constitution provides the president with immunity in such cases. Prime Minister Yousaf Raza Gilani was also present at the meeting.

The Supreme Court on January 3 gave a seven-day deadline to the government for the implementation of the National Reconciliation Ordinance, which included an order to the government to write a letter to Swiss authorities to reopen cases against President Zardari.

The meeting continues in the President House, and sources say that the Memogate issue will be discussed along with upcoming Senate elections, current political situation of the country and relations with coalition parties. ….

‘Memogate’ commission should examine existing evidence, not create new evidence

What is ‘Memogate’? The ‘memo’ in question is a letter allegedly written at the behest of Pakistan’s President by the Ambassador to Washington Husain Haqqani, asking USA to prevent a possible military coup in Pakistan after US Navy Seals killed Osama bin Laden in Abbottabad, Pakistan on May 2, 2011. Haqqani denied the allegations, sent in a letter offering to resign in order to facilitate an impartial inquiry, and returned to Pakistan to clear his name. Instead, he found his resignation letter accepted. The Supreme Court barred his exit from Pakistan. He has been forced for his own safety to confine himself first to the Presidency and then to the Prime Minister House. On Dec 30, 2011, The Supreme Court in response to a petition against the ‘memo’ formed a three-member judicial commission to look into the matter that the media has dubbed as ‘memogate’.

Asma Jahangir, counsel for Husain Haqqani and former Supreme Court Bar Association President, has refused to appear before the commission saying that she does not trust the judiciary. She has said that instead of forming a commission to create or produce new evidence the Supreme Court should have looked into the evidence placed before it to decide whether there was a prima facie case and whether the court could proceed to enforce any fundamental rights by making a binding order.

The entire affair appears to be geared towards undermining the democratic political process in Pakistan – specifically at targeting President Asif Ali Zardari, using Husain Haqqani as a vehicle. Asma Jahangir has unequivocally termed the Supreme Court’s judgment as a victory for the military that has run affairs in Pakistan for decades and is obviously still all-powerful behind the scenes.

Asma Jahangir has argued that the Supreme Court had no right to bar Haqqani’s travel abroad. Nor does Supreme Court or the judicial commission set up, have the right to demand Blackberry (RIM) data without due process of law. No server (BU or RIM) should share data with Commission, which is essentially pursuing a political dispute, not criminal charges. The judiciary seems to be ruling on the basis of national security ideology instead of constitution and law.

A Statement from the Asian Human Rights Commission

AHRC-STM-213-2011 (12-23-2011): The Prime Minister has accused the Pakistan army of hatching conspiracies against the elected parliament and government. The PM, in an address to the National Assembly session, has hinted that conspiracies are being hatched to ‘pack up the elected government’ pointing at the army and making a strong assertion that parliament is the highest of all the state organs. He declared that all the state organs, including the military, are answerable to the parliament and the government would not allow anyone to claim to be state within a state.

Prime Minister Gillani’s speech was the outcome of the statements submitted in the Supreme Court by the Chief of Army Staff and the chief of the ISI, the inter services intelligence agency, in the case of the ‘Memo Gate Scandal’ wherein the former Ambassador to the US was implicated by a Pakistani-American businessman for writing a memo to former chief of the US army to use his offices to stop the Pakistani Army and ISI making a coup against the civilian government. Through the memo the Pakistani-American businessman was also accusing that President of Pakistan, Mr. Asif Zardari, being a boss of the Ambassador was involved in writing a letter against his own military top brass.

The usual rumors are afoot. Apparently this time the army wants to get rid of Zardari, cut PM Gilani down to size, then install an interim regime and hold elections. Imran Khan is being launched with obvious establishment support, but he is not the only card they hold. Many windows are open on that computer screen. The Mullah-military alliance has been called into service. Why? to raise the price in the next round of bargaining with the US embassy? To get muscle in place for the next elections? to support a real hard coup? who knows. But some brilliant scheme is afoot and we will soon see what it is.

Some analysts are warning that the army is playing with fire here, but the army thinks these people are under control and if truth be told, they are…when and where has Sami ul haq or Hafiz Saeed taken any step that has offended the army? these are the good jihadis and the army does not fear their going out of control. You can complain that such productions eventually raise the “black banners of Khorasan” temperature in the nation and are not conducive to future plans for capitalist utopia, but the army (and for that matter, the US embassy and even the much wiser Chinese embassy) doesnt think like that…they are all “practical people”. I suspect that the “deep thinkers” in GHQ as well as their patron embassies believe that bombs go off because bombs are made and bombers are trained and sent by people who know what they are doing, “culture-vulture” has nothing to do with it. They are far more cynical about these things….what else explains this madness?

Meanwhile, the middle class is primed and ready for another round of army-sponsored “clean government”It almost seems like its fated to happen. Every few years the middle class comes to a fork in the road: do we accept that we are a normal country with normal problems (normal as in “norm”) and they will have to be solved using normal methods that work or dont work in the whole wide world? or do we double down and bet that this time the angels in aabpara will get it right and armies of efficient capitalists animated by the two nation theory and the spirit of jihad will raise the GNP and the black bannerof khorasan and blah blah blah? And every few years, the blessed middle class says YES to aabpara and away we go, for one more crazy ride until all the bullshit runs out and incompetent and corrupt civilian janitors (the others having been hanged) are called in to clean up the shit…..

In the long run, I think the army and its bed fellows will move on to more “normal” statist third world capitalism (http://www.3quarksdaily.com/3quarksdaily/2011/12/the-historic-task-of-the-pakistani-bourgeoisie.html). But they are not yet ready for such a tame country. Selling nuisance value may be a risky and high stakes game, but its not without its thrills and rewards. Fasten seat belts.

Pakistan PM hits out at army amid ouster fears

ISLAMABAD – Pakistan’s embattled Prime Minister Yousuf Raza Gilani on Thursday said conspirators were plotting to bring down his government and delivered an unprecedented tirade against the powerful military.

In astonishing confirmation that he fears being ousted, he angrily denied the government was subservient to the army, long considered the chief arbiter of power in Pakistan as his administration grapples with a damaging scandal.

Pressures are at boiling point over a memo, allegedly written with approval from the president, asking for US help to prevent a feared military coup after Osama bin Laden was killed in May.

Rampant speculation that President Asif Ali Zardari could be forced out of office over the scandal and illness has refused to ease, despite his return to the capital following two weeks of medical treatment in Dubai.

“I want to make it clear today that conspiracies are being hatched here to pack up the elected government,” Gilani told a gathering at the National Arts Gallery, without naming anyone.

“But we will continue to fight for the rights of people of Pakistan whether or not we remain in the government,” Gilani said, declaring himself the country’s longest serving premier, with 45 months on the job. ….

Pakistan’s “Memogate”: Was there ever going to be a coup?

For all the fevered discussion about Memogate, one of the most arresting claims to emerge seems to have evaded even the faintest scrutiny. In the very evidence Mansoor Ijaz marshaled before the Pakistani public, he says there was a second, rival plot, set in train during the very same days in early May. It, too, involves a senior Pakistani official reaching out to foreign allies in a similarly abortive bid to take on a powerful institution back home.

About a quarter of the way down the purported BBM exchange between Ijaz and Husain Haqqani, the American businessman proffers an eyebrow-elevating tip. Some hours after the memo was delivered, Ijaz tells his alleged co-conspirator that he has learned of a clandestine effort to evict Asif Ali Zardari from Islamabad’s presidential palace.

I was just informed by senior US intel,” Ijaz writes in a message on May 10, “that GD-SII Mr P asked for, and received permission, from senior Arab leaders a few days ago to sack Z. For what its worth.” It’s worth a great deal, if only because it carries the same weight as what else appears in the apparently incriminating exchange. In his hasty typing, where he manages to turn “DG-ISI” into an anagram, Ijaz was saying that top American spooks have told him that Lieut. Gen. Ahmed Shuja Pasha secured a green light from Gulf potentates to overthrow the government.

Intrigued, I asked Ijaz to furnish some context. When the memo was being crafted, he told me in a telephone interview some days ago, he wanted to independently verify whether the Zardari government was truly imperiled. “One of the things I had done,” he explained over his London cell phone, “was to make sure that a senior person that I know in US intelligence would have had the opportunity to review what was about to sent over.” This, he added, was why Leon Panetta came to know of the memo, hinting at a CIA link.

Ijaz said he felt the measure was necessary “to make sure that there was nothing we were doing that was against US interests.” The well-placed source got back to him about a day later. “And the person told me,” Ijaz said, “that their information was that Pasha had traveled to a few of the Arab countries to talk about what would be necessary to do in the event they had to remove Zardari from power and so forth.”

Did he find the information credible? “Of course I thought it was credible,” Ijaz replied, slightly exasperated by the question. “I wouldn’t have repeated it if I didn’t. When I say, ‘a senior intel source,’ I mean senior,” he said, laying stress on the last word. Based on what his source told him, Ijaz said he had “confirmation that there was a real threat there at some point.”

The question of whether the shadow of a coup ever fell on the early days of May lies at the very root of Memogate and remains unresolved. Ijaz has claimed that coup jitters spurred Haqqani into action. Indeed, all claims in this regard emanate from Ijaz. They appeared in his column on the pink pages of the FT and in the memo that he dispatched. Haqqani, by contrast, denies there was ever talk of a fourth phase of Pakistani military rule. The army and the ISI, at least on this occasion, won’t disagree with the former ambassador.

And judging by the government’s reaction at the time, the need never arose. Before the memo even reached Admiral Mullen’s inbox, Yousaf Raza Gilani had already bellowed his support of Pakistan’s military-led spies. “Indeed, the ISI is a national asset and has the full support of the government,” the prime minister told parliament on May 10. “We are proud of its considerable achievements…” Gilani also failed to call for the “independent inquiry” floated in the memo, handing the responsibility instead to the army’s adjutant general. And a day later, the prime minister told me that the government, the army and the ISI were “all on the same page.”

So, the only one claiming that Gen Pasha was busily touring Arab capitals enlisting support for a coup is his London host. Like other allegations made in the Memogate affair, it rests on Ijaz’s credibility. If he is telling the truth, and his entire account is to be accepted, then both Haqqani and Gen Pasha were involved in shadowy schemes that merit further inquiry. And in each case, questions will inevitably arise about how much their respective bosses knew.

We already know that Ijaz has at least been right about Haqqani’s travel itinerary. The former envoy concedes that he was in London on the dates his accuser mentions. Gen Pasha’s movements are more opaque. According to news reports of May 7 – two days before Ijaz alleges Haqqani contacted him – the spy chief slipped out of Pakistan that day for “a sudden foreign visit”. The Nation newspaper, among others, reported that its sources said the “ISI chief’s visit could be to China, Saudi Arabia and UAE where he is expected to meet senior defence and military officials of these countries to brief Pakistan’s stance.”

Even if Gen Pasha did travel to these countries, two of which clearly qualify as homes to “Arab rulers,” perhaps nothing unseemly took place. Perhaps all that was discussed, quite appropriately, was Pakistan’s reaction to the bin Laden raid. But if Ijaz is wrong about the nature of Gen Pasha’s trip, then his other claims begin to crumble. It becomes very difficult to sustain the argument that he was telling the truth about Haqqani but lying about Gen Pasha.

Siraiki Province: PML-N Falling Into Zardari’s Trap; To Be Limited To Central Punjab

In a glaring example of cynical, reactionary and unprincipled politics, Punjab CM Shahbaz Sharif the other day demanded that Sindh be divided and Karachi be made a province. His statement justifiably created furore in Sindh and the parliamentary parties including PPP, MQM and ANP as well as other politicians and activists swiftly condemned the unimaginative and unscrupulous statement by the PML-N leader.

The PML-N government and Punjabi nationalists seem to be under considerable pressure as the demand for a separate Siraiki province is gathering momentum in southern Punjab but this was most crooked and uncalled for response that could ever come from anyone with even the slightest political wisdom. PML-N leader was obviously trying to get back with the PPP. It may be noted that PM Gilani has suggested the creation of a new province in southern Punjab and PPP manifesto committee is deliberating to make it a part of the PPP manifesto for next elections.

No Sindhi would have any objections if Shahbaz Sharif, other PML-N leaders and Punjabis as a whole turn into nationalists but all the Punjabis and others should understand that Sindh and PPP are not ONE and the same. They are two separate entities. PML-N can’t and shouldn’t get back with the PPP by hurting Sindh. It must agree or disagree with the Siraiki people’s demand for a separate province with the force of arguments and not by playing tit for tat, conspiratorial and ugly politics.

PML-N should also realize that with this kind of politics they will be completely routed out from Sindh and their aspirations to become a “national” party or to form next government will die for ever.

Do they understand that this is exactly what PPP co-chairperson Asif Ali Zardari wants the PML-N to do? Are they willingly falling into the trap set by Zardari ..? Do they realize that with this kind of politics, they will forever become a Central Punjab party? Are there any sane elements in PML-N who would rein in Shahbaz Sharif and the likes of him in their party? Guess not. Good luck to them on their journey to doom.

Lord Wavell, a commander of the British forces in the Middle East and later a Viceroy of India, had been commenting on the treaties bringing World War I to an end and the future shape of the post-Ottoman Middle East, but the mad dash towards ‘peace and reconciliation’ in the Pak-Afghan region over the last two weeks suggests that after a decade-long war, we too may be in for more turbulence, not tranquillity.

The very connotations of the terms truth, peace and reconciliation make it nearly impossible to say anything critical of — let alone contradicting — the process. But when the inimitable host of VOA’s Pashto service, Rahman Bunairee asked me last week to comment on President Asif Ali Zardari’s remarks in Turkey about opening up of a Taliban diplomatic office there, I found it difficult not to be cynical about the whole drama. “Since when does the president have such clout to determine Pakistan’s foreign policy, especially vis-à-vis Afghanistan,” I responded. Thinking of Wavell’s words, I added that what appears now to be a solution to a problem will likely be the mother of many larger problems to follow. President Zardari was speaking for the Pakistan Army and the so-called peace proposal — the diplomatic street address for the Taliban included — had been drafted in Rawalpindi. The civilians may have been acting it out, but the script is unmistakably Khaki. ….

…. In the Afghan memory, Pakistan, for three decades, has been part of the problem, not the solution. Each time that Pakistan has ‘sponsored peace’ there, rockets have rained on Kabul. Pakistan has miscalculated the Afghan and the US readiness to accept it as a partner in peace and the Gilani-Kayani-Pasha delegation to Kabul is being seen as a too-clever-by-half move to shoulder out the legitimate stakeholders. Unless Pakistan comes clean on the jihadist terrorists it harbours, any peace it sponsors will mean an end of all peace.

Imran Khan to block NATO supplies lines to express his party’s protest against drone attacks

Imran Khan the chief of the Tehrik-e-Insaf party announced in a program/ talk show  “Kharri Baat with Lukman ke Saath”,  “2-3-days” blockade of NATO supply lines to express his protest against drone attacks in Pakistan. He said, he & his party workers will stage sit-in protests at several points to block NATO’s supply routes. He also condemned the Zardari-Gilani government, saying the current regime is like a vehicle that has exhausted.

ISI Chief Lt. General Pasha gets another extension! Will Supreme Court Intervene?

Islamabad: Director General Inter Services Intelligence (ISI) gets another two years extension in his service, thus all four civilian and the uniformed top brass will remain in the office till 2013, sources in the power corridors revealed to Indus Herald today. However, whether the extension will be taken as a violation of the Supreme Court orders or the extension will bring the political stability in the country is yet to be determined.

Sources placed in the government have confirmed that Prime Minister Syed Yousuf Raza Gilani sent a summary along with his advice for the two years extension in the service of DG ISI Lieutenant General Ahmed Shuja Pasha, which is duly accepted by the president yesterday and thus his present tenure is again extended.

The second extension will start at the end of his first extension tenure that was awarded last year when he was about to retire, but first extension under the law was given for one year.

It may be mentioned that general Kayani, the COAS was also given an extension in his service and also in his tenure as army Chief, ….

However, the critical aspect of the extension will be reaction of the Supreme Court on the decision as it has already terminated number of high-ranking police officers including DG FIA, Waseem Ahmed whom the government of the day considers critical in the war on terror. ‘In fact every institution shall work within its limits, and should not intervene in the jurisdiction of any other institution’, said Faisal Raza Abidi.

‘We follow double standards as the registrar Supreme Court is already given two years’ extension by the CJ himself, while army chief is also enjoying an extension, but the civilian government is not allowed to give extension to any civilian officer because of certain other reasons’, commented a senior PPP leader. ‘It is the time now for the Supreme Court to take notice of this extension and set an example’, he added.

Pakistan assembly fails to denounce Bhatti’s death

While Pakistan Prime Minister Yousaf Raza Gilani announced a national mourning for the slain minister for minorities, Shahbaz Bhatti, many politicians and political parties in the country have chosen to remain silent on the issue. In the country’s parliament, a joint statement also could not be iss ued as many MPs refused to condemn the killing.

The main opposition parties, headed by the PML-N party of Nawaz Sharif, has remained strangely silent. Religious parties, which include the Jamaat-e-Islami party have termed the murder a plot to malign Pakistan.

A similar silence was seen when Punjab Governor Salmaan Taseer was shot earlier this year. After that killing, most political figures including Nawaz Sharif, and his brother Shahbaz Sharif, who is the chief minister of Punjab, stayed away from the funeral prayers of the slain governor.

This silence is seen as an endorsement for the murder,” MP Asia Nasir, a Christian, said in parliament. Nasir also pointed to the picture of Muhammad Ali Jinnah hanging on one wall in parliament and told the assembly that it was a sad day for minorities.

He was brave, courageous and daring—a great man who spoke for the rights of the people including minorities. He was totally committed to the high democratic ideals and the egalitarian vision of Quaid-e-Azam Mohammad Ali Jinnah, Shaheed Zulfikar Ali Bhutto and martyred Benazir Bhutto.

Salman was held in highest esteem by the people who respected his boldness to proclaim loud and clear that he believed in liberal and secular politics. He was targeted for elimination for having defended the rights of minorities against the black and discriminatory laws introduced by dictator General Ziaul Haq to terrorise the people into submission to his totalitarian rule. …
