One suo motu too many – By: Tausif Kamal

Whenever some of our preconceived myths are shattered by a stark, unyielding and yet truthful reality, we tend to revert to denial and a refusal to face up to the facts as they are

The Supreme Court’s short order in the Arsalan Iftikhar case absolving the Honourable Chief Justice (CJ) without any investigation or examination of any evidence in the underlying imbroglio is premature. It is in fact contradicted by the Supreme Court’s own statement in this order: “…the Supreme Court (SC)…cannot judge the guilt or innocence of the parties without evidence or trial…” So how is this ruling not applicable to the CJ, who is so intertwined in this scandal being the father of one of the main suspects, and whose judicial power is at the heart of this corruption scandal?

This is in way to imply that the CJ is guilty but there cannot be an exemption from inquiry and investigation along with other participants and witnesses, for possible criminal violations based just on mere words of one of the parties. Who is Malik Riaz to give a clean bill of health to the CJ? It is strange that the SC is relying on the good word of Malik Riaz whom the former considers to be an accused fit to be prosecuted for some serious criminal offences under Pakistan’s criminal laws.

To contend that the media is maligning the judiciary by highlighting this scandal is to blame the messenger and not the message. Let us not be sidetracked, for now at least, by corruption in the media, which no doubt prevails, but which is less important than the imperative of our judiciary to have an unassailable reputation and an image above reproach. Conducting a thorough probe or inquiry of all those allegedly involved, including the Honourable CJ, will clear rather than tarnish the judiciary’s reputation and remove the dark clouds hanging over our most esteemed institution.

The nation has a right to know answers to such vital questions as how long the CJ knew about his son’s involvement with Malik Riaz and how many meetings the CJ had with Malik Riaz before the matter was seized through a suo motu action. The only other acceptable alternative to such an inquiry would be for the CJ to quit honourably in the larger interests of the judiciary and the country.

ISLAMABAD: Former army chief Gen Mirza Aslam Beg has blamed the Inter-Services Intelligence (ISI) for distributing money among various politicians to rig the 1990 elections as alleged in air marshal Asghar Khan’s petition.

Maintaining his innocence, Beg submitted another statement before the Supreme Court, in which he claimed that the ISI was a separate entity from the army and was not under the command of the army chief.

Beg insisted he was not directly involved in maintaining accounts and distributing funds during 1990 elections. “…In fact, the accounts were maintained by the ISI and (Beg) only instructed then DG ISI Gen (retd) Asad Durrani to maintain accounts ….

Mehran Bank Scandal: Rehman malik provided proves to media

Interior Minister Rehman Malik proved that PML-N Chief Nawaz Sharif was involved in money laundering.

He gave evidence against Nawaz Sharif would be placed before the Supreme Court and National Accountability Bureau (NAB) for alleged corruption of $32 million.

Federal Rehman Malik said a commission may be formed to investigate alleged involvement of Nawaz Sharif in money laundering.

He appealed to the Supreme Court to call him and he would present all evidence. He further alleged that Nawaz Sharif made an NRO with former President Farooq Ahmed Leghari and as a result, Benazir Bhutto’s elected government was unconstitutionally dismissed in November 1996.

Federal Rehman Malik said that Nawaz Sharif made a second NRO with dictator Pervez Musharraf and went abroad after signing an agreement and violated the Charter of Democracy (COD) he signed with Benazir Bhutto in 2006. …

Brahamdagh : No talks with government, We welcome if US, NATO or India intervene, says BRP chief

Baloch Republican Party chief Brahamdagh Bugti living in exile claimed Wednesday Baloch movement did not enjoy any foreign support, saying but they would welcome it, be it from the US, NATO or the India.

‘We know foreign powers have their own interests; we think of our own greater interests”, he said in a telephonic press conference at Quetta Press Club.

Mr. Bugti said Baloch women, leaders, activists, students, writers, poets, and intellectuals were being picked up and eventually being disappeared and eventually turning up dead. Under such circumstances, we would welcome the support of foreign countries for independence, he said.

Bugti backed the US resolution on Balochistan and justified it was not against the sovereignty of Pakistan as every country possessed right to intervene in another country’s affairs if that state was involved in human rights violations ….

Freedom for Balochistan – Protest against Pakistan’s barbarism in Balochistan

London: The barbarism of Pakistani security agencies in Balochistan continues to infuriate the Baloch people. A Human Rights Watch report titled “We can Torture, Kill, or Keep You for Years’: Enforced Disappearances by Pakistan Security Forces in Balochistan” exposes the fact that Pakistani agencies are responsible for widespread disappearances of Baloch political activists. The 32-page report slams Pakistan authorities for taking people into custody and then denying all responsibility or knowledge of their fate or whereabouts. The rights group investigated several cases in which uniformed personnel of the Frontier Corps, an Interior Ministry paramilitary force, and the police were involved in abducting Baloch nationalists.

ISLAMABAD: The principal character in the memogate scandal, Mansoor Ijaz, has said that Inter-Services Intelligence (ISI) is under nobody’s control and always keeps its hand in politics.

In an interview with CNN host Fareed Zakaria, Mr Ijaz said: “The ISI has two critical branches in it. One is called CT, for counter-terrorism, and the other one is called S Branch for strategic —it’s sort of the arm of the ISI that does everything from political interventions in other countries, for example, Afghanistan, which is what they’re doing through the Haqqani network and the Taliban right now.”

He said the ISI was an organ of the state that nobody could control. “And it is essentially the organ of the state that the army and the intelligence wings are using to, shall we say, coordinate or obstruct what it is that the political side of the government, the civilian side of the governments do in Pakistan,” he said.

Mr Ijaz said the ISI does a lot of political interventions in its own country as it has been reported in the past by Pakistani press that S Branch was involved in manipulating elections and doing things of that nature inside Pakistan.

“Now, there have been so many wrong things that have happened since the death of Bin Laden in the early part of May, so many things that indicated some hidden hand, if you will, in what was going on,” Mr Ijaz said.

Mansoor Ijaz, who claimed himself a ‘messenger’ for a memo from Pakistan’s civilian government to the Pentagon asking Washington to clamp down on Pakistan’s military, said he had been involved in different operations in Pakistan now for a very long time. However, he did not mention that what kind of operations these were. ….

‘Haqqani sahib should not use Pakistan territory for wrong activities’

Afghanistan says Rabbani’s killer was Pakistani

KABUL: Afghanistan said on Sunday that the suicide bomber who assassinated Afghan peace negotiator Burhanuddin Rabbani was a Pakistani national.

Tensions between the neighbours have been rising amid allegations from Afghan officials that Pakistan and its powerful ISI intelligence agency masterminded Rabbani’s assassination and are seeking to destabilise Afghanistan.

An investigative delegation established by President Hamid Karzai said evidence and a confession provided by a man involved in Rabbani’s killing on Sept. 20 had revealed that the bomber was from Chaman and the assassination had been plotted in Quetta, both on the Pakistani side of the border.

“It proves that the assassination of Professor Rabbani was hatched in Quetta and the man who carried out the suicide bombing is a Pakistani national,” the delegation, led by Defence Minister Abdul Rahim Wardak, said in a statement issued by the presidential palace.

“The documents and evidence in hand, details of other accomplices and their phone numbers have been handed over to Pakistan to make arrests,” it said.

Rabbani’s killing derailed efforts to forge dialogue with the Taliban to end the 10-year war, and raised fears of a dangerous widening of Afghanistan’s ethnic rifts.

The High Peace Council, which Rabbani headed, reiterated earlier comments by Karzai that negotiations should continue, but with Pakistan, rather than the Taliban.

“For the groups that are tired of conflict and want to end the killings and destruction inside the country, peace efforts must continue,” the council said in a separate statement issued late on Sunday.

“But because of those who hide in Pakistan with no known address, who send killers (to Afghanistan), we must negotiate with Pakistan instead.”

Hundreds of Afghans took to the streets of Kabul on Sunday to condemn recent shelling of border towns by Pakistan’s army and accuse the ISI of involvement in Rabbani’s killing.

Video shows terrorists in China got training in Pak bases

BEIJING: A jihadist group has released a video on the recent violence in western Xinjiang province while providing China new evidence that terrorists involved in the bloodbath were trained in Pakistan. The violence in two towns in Xinjiang bordering Pakistan left 40 dead.

But the Chinese foreign ministry refrained from naming Pakistan in its closely calibrated response to a question about the 10-minute video showing Turkestan Islamic Party leader Abdul Shakoor Damla claiming responsibility for the violence.

“I haven’t seen the video you mentioned. Our principled position is that at present, a small handful of terrorist forces..,out of motives of splitting China, are conducting rampant violent terrorist activities within China’s border [to] seriously undermine China’s national unity, and regional peace and stability,” Liu Weimin, the spokesperson, said. ….

Malik offered US all NADRA record: WikiLeaks

SINDH – KARACHI:  Federal Interior Minister Rehman Malik, back in the day, had offered US all the National Database and Registration Authority (NADRA) record so that it could easily track anyone who it suspected to be involved in terror-mongering, WikiLeaks revealed.

Detail has it that Rehman Malik as a token of tanks for aiding Pakistan came up with the offer of transferring Nadra’s record of millions of Pakistanis to US spy agencies. He also suggested signing an agreement with US to make it look legal and save the Pakistan Peoples’ Party government from any embarrassment to boot.

‘Killer’ alleges MQM has militant wing

ISLAMABAD: One of the most dangerous alleged target killers, who confessed to have killed many, including police officers in Karachi, has reportedly claimed his association with the Muttahida Qaumi Movement’s “militant wing”, and has named Dr Imran Farooq as the contact person for many party militants. He further said that Ajmal Pahari was one of the MQM’s men.

Arrested and interrogated in 2010 before the murder of Dr Imran Farooq, the accused target killer, Muhammad Ishtiaq, alias Salman, alias Police Wala, confessed before the Joint Interrogation Team comprising representatives of the ISI, IB, Rangers, CID, Sindh Police and Special Branch, as reported in an official document, that Ajmal Pahari (who was arrested recently in Karachi and is alleged to have been involved in the killing of 100 people) also belongs to the MQM.

New York Times – Pakistani Army Linked, in Letter, to Nuclear Sale

WASHINGTON — The emergence of a single-page letter supposedly written by a senior North Korean official 13 years ago has become the strongest evidence yet suggesting that Pakistan’s top military officials were involved in a secret sale of equipment to North Korea that enabled it, years later, to begin enriching uranium.

The letter is said to have been written to Abdul Qadeer Khan, the Pakistani who built the world’s largest black market in nuclear weapons technology, by Jon Byong Ho, a North Korean whom American intelligence has long put at the center of the North’s trade in missile and nuclear technologies. It reports that the chief of the Pakistani Army at the time, Gen. Jehangir Karamat, had been paid $3 million and asked that “the agreed documents, components, etc.” be placed on a North Korean plane that was returning to Pyongyang, the North’s capital, after delivering missile parts to Pakistan.

The publication of the letter comes at a particularly inopportune moment for the Pakistani military. Already discredited inside Pakistan for its failure to detect the American commando raid that killed Osama bin Laden in May, the military has veered from crisis to crisis since then.  ….

One very often hears about the fabled corruption of the president of Pakistan and co-chairperson of PPP and also about the gross irregularities, mismanagement and corruption in the federal government. The accusers among others include the PML-N leaders who claim running a very clean government in the Punjab, the largest province in Pakistan. But as this report suggests their hands are not as clean either. They have engaged in financial irregularities and also seem to be playing gimmicks for short-term political gains at the cost of the welfare of the common men.

Pakistan’s identity war — II

What does it mean to be an Islamic state? Was there ever such an entity? Can modernity, as it pertains to developing a functional society in a globalised world, be realised within the context of a theocracy? These are fundamental questions which Pakistanis need to resolve, within this generation, in order for Pakistan to develop and reach its potential.

Pakistan shares the distinction, along with Israel, as being one of only two states to have been crafted, in the post-colonial worlds, on the basis of religion. In both cases enormous migrations were involved with questionable legitimacy for the migrants. The ‘muhajir’ identity continues to be perpetuated, as such, on this basis. The creation of both Israel and Pakistan present a perplexing paradox: Created on the basis of religion, their champions were largely secular individuals. The founders of Zionism as a political force, such as Israel’s first prime minister, David Ben Gurion, were secular. So too were Pakistan’s founders, most notably the Quaid-i-Azam. I would argue that Ben Gurion and Jinnah made a dangerous bargain when it came to conflating cultural identity on the basis of religious adherence.

Pakistan and Israel — two states which don’t recognise each other diplomatically — are facing a similar radicalisation because of that initial crisis of identity which was never fully resolved. Theocratic forces are gaining power in both countries. …

Six missing persons found dead in Balochistan

QUETTA: Six bullet-riddled bodies were found from different parts of Balochistan during the three days of Eidul Azha.

According to sources, two bullet-riddled bodies were found from Kech Kaur near Hiruk area of Turbat on Thursday. They have been identified as Lala Hameed Baloch, president of the Baloch National Movement (BNM) and another Hamid Ismail. Hameed Baloch was a journalist and a member of the Gwadar Press Club. The bodies were taken to nearby hospital for autopsy.

A complete strike was observed on Friday in Gwadar, Pasni, Jiwani, Turbat and Hoshap condemning the killing of political opponents.

Another two bullet-riddled bodies were found in Kad Kocha area of Mastung, some 120 kilometers off the provincial capital. The bodies were identified as of Bashir Ahmed Lehri and Inayathullah who had been missing for more than two months.

Bashir was kidnapped along with Zahoor Baloch, a member of the Balochistan Students Organisation-Azad (BSO-Azad) in Ramazan. “The government functionaries are involved in the killings,” relatives alleged.

A bullet-riddled body of a student, Samiullah Mengal, was found near Ferozabad area of Khuzdar, some 300-kilometre from Quetta on Wednesday. Samiullah was BSO-Azad activist and had been missing for the last 45 days when he was returning to Khuzdar from Sasol.

Another body was discovered on Friday from Kapotu area of Kalat district and had been identified as Nasurrallah Baloch. ….
