When in 1928 the Turkish Parliament was opting for a secular state and the constitutional provision declaring Islam as the state religion was being deleted, 21 years down the road in 1949 Pakistan’s Constituent Assembly was passing the Objectives Resolution, moved by Liaqat Ali Khan, the Prime Minister, proclaiming that the future constitution of Pakistan would be modeled on the ideology and faith in Islam. In the 1973 constitution Islam was declared as the state religion.

When in the 1920’s sovereignty of the people was being established in Turkey replacing the sovereignty of the Caliph, in 1949 Pakistan’s Constituent Assembly was bestowing sovereignty upon Allah.

When in the 1920’s the Turkish Parliament was adopting time-tested European models to reconstruct their civil, commercial and penal law, Pakistan’s 1973 constitution envisaged that ‘All existing laws shall be brought in conformity with the Injunctions of Islam as laid down in the Quran and Sunnah.’

Chinese worker cleared of blasphemy in Pakistan

MUZAFFARABAD: Authorities in Pakistan-administered Kashmir on Thursday cleared a Chinese man accused of committing blasphemy by desecrating a Quran, officials said.

Lee Ping, the administration manager of a Chinese consortium building a major hydropower project, was accused on May 17 of throwing the Islamic holy book on the ground, prompting hundreds of workers to attack his company offices.

Blasphemy is a highly sensitive issue in Pakistan, where 97 per cent of the 180 million population are Muslims. Even unproven allegations can spark a violent and sometimes deadly public response.

Police took Lee into protective custody at a secret location after protests erupted at the company offices near Muzaffarabad, the main town of the disputed Himalayan region, but on Thursday he was cleared.

“Police investigation has cleared the Chinese worker of desecration of Quran charges,” cabinet minister Matloob Inqalabi told reporters.

LAHORE: Top leaders of Pakistan Tehreek-i-Insaf (PTI) met Minhajul Quran International (MQI) chief Dr Tahirul Qadri in Lahore on Wednesday to discuss their reservations over the current Election Commission of Pakistan (ECP).

PTI president Makhdoom Javed Hashmi told the media that the reservations were only discussed during the meeting, but the final decision will be taken by his party regarding the petition being filed in the Supreme Court by Qadri for the reconstitution of the election commission.

PTI vice chairman Shah Mehmood Qureshi said that a transparent ECP is crucial for the upcoming elections, “but the government claims that it cannot dissolve the election commission as it is against Article 209”. ….

When the pseudo-sentiments of the pseudo-religious are pseudo-hurt

In neighbouring Pakistan, an Islamic cleric recently accused a young Christian girl, Rimsha Masih, of blasphemy, a charge punishable by life imprisonment. He said she had burnt some pages that contained verses from the Quran. The 14 year old girl hails from a poor family and suffers from Down’s Syndrome. An eyewitness to the event showed courage and told a magistrate the truth: it was the Muslim cleric who had put those burnt pages in Rimsha’s bag. The cleric has been arrested and is set, in turn, to be charged with blasphemy.

I have been thinking about the incident. Insulting somebody’s religion is bad. It may cause offence. Often it is intended to cause offence. If somebody insults Islam, by doing things like burning pages containing verses from the Quran, it is bound to outrage a Muslim.But what happens when the Muslim has burnt those pages to implicate a Christian? Where does the outrage disappear? Why are the right-wingers and the mullahs in Pakistan suddenly silent? The cleric’s lawyer had threatened the judge that if the girl is let off she could be lynched – such was the outrage! Where has the outrage suddenly disappeared? Where are the calls for lynching the blasphemer to death?

And what does this hypocrisy tell us? It tells us that such outrage is, in the first place, fake.  That their religious sentiments weren’t really hurt when they said they were hurt. It was just that they wanted to persecute Christians and for doing so they were happy to commit blasphemy that they could then accuse Christians of doing!

What does that tell you of the claims of such people over how strong their religious, nationalist or whatever “sentiments” are?

I have noticed several such incidents in both Pakistan and India in the recent past. Let me give you a few examples.

Prayer leader arrested for fabricating evidence in Rimsha Masih case

RAWALPINDI: Police have arrested prayer leader Khalid Jadoon on charges of fabricating evidence, which he had used to accuse Rimsha Masih of committing blasphemy by allegedly burning Quranic pages, Express News reported early on Sunday.

Express News correspondent Qamarul Munawar said that Hafiz Muhammad Zubair, who witnessed Jadoon adding pages of the Quran, recorded a statement with the Rawalpindi magistrate on Saturday.

According to Zubair’s account, he was sitting in Iteqaaf in the mosque when some people handed burnt pages to the prayer leader. After a little while, Jadoon added additional pages of the Quran to the pile.

Zubair, in his statement added that three other people present with him in the mosque asked Jadoon why he was adding documents to the pile of burnt paper, to which prayer leader said that such an act was necessary to strengthen their case.

Munawar reported that Islamabad police has now arrested Jadoon who are now questioning him.

Rimsha has been in custody since she was arrested more than two weeks ago accused of burning Quranic papers, in breach of Pakistan’s blasphemy laws. According to medical reports Rimsha is 14 year old minor, and has a mental age below her real age.

New blasphemy low – downs syndrome girl arrested!

We have received reports of a new and appalling low in the ongoing abuse of blasphemy laws. Allegedly, a Quran was found with some of its pages burned by Muslims in a Christian area of Islamabad – in previous cases the burning has nearly always shown to have been done by Muslims, or by mentally unstable people – and worse, they have had an 11 year old Christian girl with downs syndrome called Rimsha Masih arrested and charged with the crime.

I am ashamed ….

One of the most important days of my life occurred in 1994. At times a tragic event changes you as a person. They say and I agree that tragedy more than anything else has the potential to bring about change. Perhaps tragedy evokes negative emotions like hurt, fear, embarrassment and revulsion. Emotions which do not reinforce your existing state of mind but force you to look into the status quo with a critical eye.

That day changed my life forever. I had woken up and was reading the newspaper when a two column headline caught my eye. According to that news story, a crowd of several thousand had burnt a man alive as a punishment for desecrating Quran in the city of Gujranwala. The man’s name was Hafiz Sajjad Tariq and he had accidently dropped Quran on a burning stove. Being a religious person, he panicked and merely uttered words “ Oh God, I have sinned and burnt Quran”, words that were unfortunately heard by a neighbor who had just entered the house. The neighbor went out and started screaming hat Hafiz had burnt Quran.

What followed next was horrifying but perhaps not unusual. Soon there were announcements from the loud speakers (I hate that device) that Hafiz had burnt the Quran. The mullahs were urging Muslims to show their “love” for Islam and the Muslims in that city obliged. Hafiz was dragged out of his home and beaten up. At that point police came and took Hafiz into protective custody. But charged up Muslims wanted “justice” and so a mob of thousands gathered outside the police station and demanded that Hafiz should be handed over to them. The police buckled under pressure and handed Hafiz to the crowd. Crowd stoned him to death and then burnt his body. Afterwards the burnt corpse was dragged in the streets.

I felt a nauseated revulsion and just put the newspaper down. That fateful day changed my life forever. That incident demonstrated the flip side of “reverence” of religion. It showed that one could easily vent out his/her (by the way some of our Muslim sisters also actively participated) gutter instincts under the excuse of “reverence”.

ISLAMABAD: Chairman Pakistan Tehrik-e-Insaf, Imran Khan, who had a good day in Karachi on Sunday, says that under his rule no law will be made against Quran and Sunnah. He also hints that the likes of Veena Malik, the actress who remained centre of controversy for a nude photo shoot for an international magazine, would not be allowed to do so in Imran’s Pakistan.

Is a Pakistani Christian equal to a fellow Muslim?

“A young Pakistani student belonging to the Christian faith has posed an interesting question through a petition in the Lahore High Court. The question is: Am I, a Pakistani Christian equal to a fellow citizen who is a Muslim ? For those of the readers who missed the news item reported by an English daily, this young student belongs to a low income group, is a practicing Christian and extremely bright. She has been competing to get into the King Edwards Medical College but was beaten on the list by 20 marks by a Muslim student who got the extra 20 marks for being Hafiz–e-Quran. So, now this young Christian girl has filed a plea in the Lahore Court declaring that she and the Muslim student had equal marks but the latter got the advantage of religion. The young Christian student claims that “this is discrimination against religious minority students and a violation of fundamental rights granted by the Constitution of Pakistan.” The petition admitted by the Lahore High Court demands that either the LHC should rule to abolish the policy or should declare that a parallel policy should be made to award twenty additional marks to religious minority students on the basis of their religious knowledge. Fifty eight years after the creation of the country to ask such a question through the courts is both tragic and hopeful”.
Constitution of Pakistan, Part II, Chapter -1, Fundamental Rights, Article 22 says:-

(1) No person attending any educational institution shall be required to receive religious instruction, or take part in any religious ceremony, or attend religious worship, if such instruction, ceremony or worship relates to a religion other than his own.

(2) In respect of any religious institution, there shall be no discrimination against any community in the granting of exemption or concession in relation to taxation.

(3) Subject to law: (a) no religious community or denomination shall be prevented from providing religious instruction for pupils of that community or denomination in any educational institution maintained wholly by that community or denomination; and

(b) no citizen shall be denied admission to any educational institution receiving aid from public revenues on the ground only of race, religion, caste or place of birth.

(4) Nothing in this Article shall prevent any public authority from making provision for the advancement of any socially or educationally backward class of citizens.

JuD ‘teaching’ Islam to Hindu flood victims

ISLAMABAD: Hundreds of people, including Hindus, staying in flood relief camps run by a front organization of the Jamaat-ud-Dawa in Sindh province are being “peppered liberally” with Islamic teachings , according to a report.

About 2,000 living in tents in camps set up by the Falah-e-Insaniyat Foundation , the relief arm of the JuD, were rescued by the group’s volunteers.

They are provided meals twice a day “peppered liberally with religious teachings” , The Express Tribune reported. “They remind us again and again to offer namaz,” said a man at a relief camp in Badin. He said families have been given copies of the Quran. “Namaz parho, Quran parho, safai karo! (Say your prayers, read the Quran and clean up),” mimicked a refugee.

Delusions of being Islamic

So long as we keep blaming others for our woes, so long we will not realise that the fault is ours for allowing others to take advantage of us. Pakistan pompously professes to be an Islamic Republic but doesn’t know what that means. Which Islam? The Islam of God or one of the 72 versions of the cleric? That is our core problem from which all other problems arise. We don’t know who we are and why we are. This leads to an erosion of self-confidence and self-esteem (except in rhetoric), the lack of which make us in thrall of alien ideologies and their political, economic and social constructs.

This poem on the Holy Quran written some 35 years ago by the ninth President of India, Dr Pandit Shanker Dayal Sharma, says it beautifully. It’s very good because it’s very true. I have translated it myself.

Amal ki kitab thi.

Dua ki kitab bana dia

It was a command for action.

You turned it into a book of prayer.

Samajhne ki kitab thi.

Parhne ki kitab bana dia.

It was a Book to understand.

You read it without understanding.

Zindaon ka dastoor tha.

Murdon ka manshoor bana dia.

It was a code for the living.

You turned it into a manifesto of the dead.

Jo ilm ki kitab thi.

Please don’t take kneejerk offence. Righteous rage before thinking is a hallmark of the ignoramus. Don’t focus on who says something but on what he says.

Look at the Muslim condition. They remain on the lowest rung of the ladder. The Jews, numbering less than the people who live in Karachi, are on the top rung. Why? Because they educated themselves, used their minds, recognised and understood the real levers of power, bought stakes in them and became the most powerful people in the world. The Muslims, on the other hand, remain mired in ignorance, waiting for divine deliverance without bothering to lift a finger, fooling only themselves by wallowing in their undoubtedly glorious past, deluded in their present illusions. They live on homilies and humbug.

The Federal Shariat Court (FSC) has declared whipping for the offence of drinking as un-Islamic and directed the government to amend the law to make the offence bailable.

A full-bench of the FSC comprising Chief Justice Haziqul Khairi, Justice Salahuddin Mirza and Justice Fida Mohammad Khan gave the ruling on Thursday after hearing the arguments that the Holy Quran asks Muslims to stay away from liquor but does not specifically declares it Haram, or prohibited. ….

Almost in every 2 hours a woman is raped in Pakistan. Yet, Ameer Jamaat-e-Islami insists she not report her rape to police

A viral video of Ameer Jamat-e-Islami (JI) Munawwar Hassan defending the silence over the rape of women and condoning imprisonment of female rape victims if they fail to produce four male witnesses in accordance with the Hudood Ordinance, has deeply outraged many sane people in Pakistan.

According to Hassan, if a woman cannot produce four male witnesses present at the time of her rape, she be imprisoned based on Hudood Ordinance and Shariah Law. This, he claims is in the best interest of women who are raped so if she fails to produce the witnesses she ought to refrain from filing an FIR altogether.

According to Hassan, somehow, it is in the best interest of the society for a woman to stay silent after being raped, while the perpetrator roams free.

I can’t help wonder if the leader would preach silence if a member of his family was attacked.

In the video, the Ameer inexplicably labels the Women’s Protection Bill as an effort to spread “vulgarity, nudity and shamelessness” in Pakistan, while demanding the seemingly intimidated anchor quote verses from the Holy Quran, who eventually has to descend into a monologue to prove his own Islamic credentials before being able to propose an argument to defend raped women. Interestingly, the Ameer himself fails to present any Quranic verse or Hadith to back his views.

The repugnant manner in which the host of the talk show is dismissed, and labeled an infidel for challenging the Holy Quran and Hadith, is a classic example of moral policing by self righteous Muslims in the country, who are masters at evading rationality.

I sincerely hope these morally, self righteous people read Maheen Usmani’s piece titled ‘Why the deafening silence after rape’ which cites horrific facts about rape in Pakistan including “Situation of Violence against Women in Pakistan 2010” by Aurat Foundation, according to which  a total of 4,069 cases occurred in Pakistan last year.

Every two hours, a woman is raped in Pakistan and every eight hours, gang raped. And after all this, we are confronted with the reality that in this land, where the taste of justice for many is nothing but bland and vapid, 70 per cent of the crimes against women go unreported.

But how silly of those supporting the Women’s Protection Bill to seek greater freedom and protection of women in a society suffering from an obsessive compulsive disorder regarding female sexuality, and the shame/honour dichotomy. The last thing then this country needs is rights for some 51 per cent of population. …

Pakistani Actress Slams Cleric for Criticism

ISLAMABAD (AP) — A Pakistani actress castigated for appearing to cuddle with an Indian actor on a reality show lashed out at a Muslim cleric who had criticized her during a widely watched television exchange this week.

The unusual outburst, punctuated by tears, came at a sensitive time in a country where Islamic fundamentalism is spreading and liberals are increasingly afraid to express their views.

“What is your problem with me? You tell me your problem!” an angry Veena Malik asked the Muslim scholar, who accused her of insulting Islam.

Earlier this month, a liberal Pakistani governor was shot dead for opposing the country’s harsh laws against blasphemy. In the aftermath, his killer was cheered as a hero among many in the public, shocking the country’s small liberal establishment.

Malik, 26, participated recently on Bigg Boss, an Indian version of “Big Brother.” Clips of the show on the Internet include ones in which she appears cozy with Indian actor Ashmit Patel. Those scenes, and her involvement with a show in Pakistan’s archrival India, prompted criticism online and on the air.

“You have insulted Pakistan and Islam,” Mufti Abdul Qawi accused her on the Express TV channel talk show via a television link. The exchange first aired Friday and then again Saturday.

A furious Malik shot back, saying Qawi targeted her because she is a woman, reminding him that the Quran admonishes men not to stare at a woman’s beauty beyond a first glance, and telling him there were bigger problems in Pakistan, including the alleged rape of children at mosques.

During the exchange, Qawi admitted he had not seen the clips of the show but had heard about it from others.

“What does your Islam say, mufti sir?” the actress asked. “You issue edicts on the basis of hearsay.”

Malik said she had read the Quran and she knew what lines not to cross as a Muslim as well as an entertainer in South Asia. She pointed out that she never kissed Patel, for instance.

“I am a Muslim woman, and I know my limits,” she said. The cleric seemed unable to respond to her flood of words.

Malik’s fierce outburst sparked a barrage of comments on Twitter. While some writers said they didn’t agree with her and one called her a “porn star,” others said she was brave for standing up to the Pakistani clerical establishment, especially when such an act can mean personal danger.

Wrote one supporter: “The only way to talk to these bloody clerics is to talk down to them. Veena Malik did just that, and how. Good for her!”

Blasphemy and the Islamic way

Due to some recent events in Pakistan, the issue of blasphemy is again in the news. It is generally held that Islam prescribes capital punishment for those who commit blasphemy; that is, using abusive language against the Prophet of Islam. But this is quite untrue. According to Islam, blasphemy is simply a misuse of freedom and not a cognisable offence; the blasphemer is not liable to incur legal punishment. This kind of law has no basis in Islamic scriptures. If someone uses abusive language against the Prophet, Muslims must take it as a case of misunderstanding, and then try to remove this misunderstanding. They are required to do so by engaging in discussion or by providing the blasphemer with Islamic literature that gives the true image of the Prophet of Islam.
To use abusive language against the Prophet or to praise him are both a matter of one’s own choice. Whatever the choice, it is in God’s domain to pass judgment on it. Muslims have nothing to do in this situation except try to remove the misunderstanding and then leave the rest to God.
If there is such a case – which could be called blasphemy – and in anger one tries to punish the offender, one is simply reacting negatively to the situation. And acting in this way is looked upon with extreme disfavour in Islam. Islam always tries to go to the root cause of any given problem.
When one abuses the Prophet of Islam, it is most probably due to some kind of provocation. Without provocation, this kind of negative attitude is extremely unlikely. That is why the Quran advises Muslims to get at the real reason.

The Quran points to one such root cause behind this kind of act and urges Muslims to try to come to grips with it: “But do not revile those (beings) whom they invoke instead of God, lest they, in their hostility, revile God out of ignorance.” (6:108)
It is on the record that, during the Prophet’s time, there were some non-believers who used to use abusive language against the Prophet of Islam. The Prophet of Islam never suggested any legal punishment for those persons. He simply directed them to one of his companions, Hassan bin Sabit al-Ansari, who would respond to their blasphemous statements and remove their misunderstanding by means of argument.  Islam suggests capital punishment for only one offence, and that is murder.

The well-known English journalist Robert Fisk has presented a detailed investigative report, ‘The crimewave that shames the world’ in The Independent, September 7, 2010, about so-called honour killings. Not surprisingly, the highest incidence of such crimes is in the Muslim world, though even some non-Muslim Middle Eastern minorities and Hindus in India practise it. What I found particularly shocking was that after murdering a daughter or sister, a Muslim culprit can walk away scot-free because the Islamic law of qisas (retaliation) allows heirs to pardon the criminal. Thus, other family members can pardon the offender. All such relics of barbarism have to be done away with. Already in the 19th century, Maulvi Chiragh Ali wrote that the Quran is not a book of law. Justice Munir has also advanced similar arguments. Privately, most of the educated Muslims I talk to agree with me that hudood laws, blasphemy laws and many other such laws are anachronisms that have no place in the 21st century. More such voices need to be heard in the public space.

The task in hand for modern Muslims is to separate the spiritual, moral and ethical message of Islam from penal laws reflecting the sensibilities of tribal society of the seventh century.

Stoning to death is practised as a routine punishment for adultery in Iran and Saudi Arabia. When the Taliban ruled in Afghanistan, they too imposed it with a relish and did it with the same enthusiasm in their enclaves called Islamic emirates when they ruled in some pockets of Khyber Pakhtunkhwa and Swat valley. There is no doubt that the origin of this barbaric punishment is the Old Testament of the Jews. The Jewish Torah prescribes it for a host of other offences as well. It is not mentioned in the Quran. However, all the five schools of Islamic jurisprudence — Hanafi, Shafai, Maliki and Hanbali of the Sunnis and the Ja’afri of the Shias prescribe it for adultery. Harper condemns Qur’an burning plan

Prime Minister Stephen Harper added his voice to the global outcry against a U.S. church’s plan to burn 200 copies of the Qur’an on Saturday — the ninth anniversary of the Sept. 11 attacks.

“I don’t speak very often about my own religion but let me be very clear: My God and my Christ is a tolerant God, and that’s what we want to see in this world,” he said.

“I unequivocally condemn it,” he said. “We all enjoy freedom of religion and that freedom of religion comes from a tolerant spirit.”

The people, the civil society must stand up, call for and work for an end to the politics of hate, anger, reaction, bigotry and extremism. And to promote peace, tolerance and understanding.

The extremists are pulling everything down. We (mankind) will sink together if they are not stopped wherever they are and whatever faith they believe in – the Quran burning pastor, Fox, Glenn Beck, Zaid Hamid, Taliban, Qaeda, Shive Sena, rightists in JI, BJP, Jaish or whatever there name is … all are same breed …

Angelina Jolie upset over Quran-burning plan

ISLAMABAD (Reuters) – Actress Angelina Jolie on Wednesday joined a growing chorus of opposition to plans by a U.S. pastor to burn copies of the Quran on the anniversary of the Sept. 11 attacks, amid fears it would fan religious hatred.

The Quran-torching event on Saturday planned by Pastor Terry Jones, who heads a tiny, little-known church in Florida, is fueling growing fears about heightened Christian-Muslim tensions in the United States as well as elsewhere in the world.

Oscar-winning Jolie, who is visiting Pakistan to highlight the plight of millions of people devastated by the country’s worst-ever floods, said she would never support any such plans.

“Of course not. Of course not,” she told a news conference when asked if she supported Jones’ plans.

She said she had “hardly the words” to express her opposition to burning someone’s religious text. …
